Regulation on Waste Management
Obligations of the Waste Producer and Owner
Article 9 – Waste Producer
(1) The waste producer shall:
(a) Take necessary measures to minimize waste generation
(b) Collect and temporarily store waste separately
(c) Prepare and submit a waste management plan for prevention and reduction of waste
(ç) Keep records and ensure appropriate packaging and labeling as per principles set by the Ministry
(d) Keep municipal waste closed and ready for collection at residences and workplaces as specified by relevant authorities
(e) For wastes marked (M) in Annex‑4 and claimed not to have properties listed in Annex‑3/B, obtain analysis from authorized laboratories to certify they are non‑hazardous
(f) Obtain permission from the provincial directorate for temporary storage areas requiring authorization under this Regulation
(g) Send wastes to facilities with permits/environmental licenses in line with this Regulation and the Ministry’s principles
(ğ) Complete the Waste Declaration Form each year for the previous year starting from January and by the end of March via the Ministry’s online applications; print and keep a copy for five years (military units shall send in writing to the Ministry within the specified time and keep a copy for five years)
(h) For waste requiring UATF (National Waste Transport Form), use the UATF when sending wastes to processing facilities and comply with related procedures
(ı) If the processing facility does not accept the waste, direct the carrier to another facility or ensure the carrier returns the waste and arrange processing at a suitable facility
(i) Provide training for employees responsible for collection, transport, and temporary storage of waste and take all measures regarding health and safety
(j) In case of accidental or intentional spills and similar events, restore the site to its original state within one month depending on waste type and bear all costs
(k) Inform the provincial directorate when such incidents occur and submit a report within 3 business days including date, location, waste type and amount, cause, processing method, and site remediation details
(l) For wastes that may be considered by‑products per Article 19(1), apply to the Ministry for approval
(m) Cover costs related to identification, collection, transport, and processing of waste
(2) The waste owner is obliged to manage waste in accordance with this Regulation.
